Warranty, liability and disclaimer – Orbit Brands

1. Legal and limited warranty

Orbit Brands guarantees to the purchaser that its products will be free from defects in materials and workmanship for a period of 90 days from the date of purchase, in accordance with the Consumer Defense Code.

The warranty is limited and applicable exclusively to manufacturing defects proven through technical analysis.

2. Brands covered

This policy applies to products from the following brands:

  • Magik Boards
  • Venus Pole Dance
  • Fenix Boards
  • Morey Boogie
  • BZ Bodyboards
  • Death Surf

3. Nature of the products (high performance)

Orbit Brands markets high-performance equipment for water sports.

This means:

  • Impact is part of the usage
  • Wear and tear is expected
  • The environment is aggressive (sun, water, sand, pressure and friction)

Therefore, the warranty is objective and based on technical criteria.

4. What the warranty covers

The warranty exclusively covers:

  • Manufacturing defects
  • Material defects

Provided that they are:

  • Identified within the deadline
  • Proven by technical analysis

5. What is NOT covered (very important)

As these are sports products, there is no coverage for:

Usage, impact and wear

  • Dents, cracks, punctures, cuts or tears
  • Streaks, creases, folds or pressure marks
  • Damage from impact (rocks, seafloor, edges, structures, etc.)
  • Natural wear (scratches, scuffs, fading)

Misuse and improper handling

  • Use outside of intended purpose
  • Twisting, dropping, stepping on, improper tightening
  • Use without following basic guidelines

External conditions

  • Excessive exposure to sun or heat (e.g., in a closed car)
  • Improper storage
  • Incorrect maintenance

Product alterations

  • Modifications or repairs by unauthorized third parties
  • Structural alterations or improper drilling

Other cases

  • Commercial use or rental
  • "Second-line" products (when noted)
  • Lost, stolen or unrecovered products
  • Claims without the original invoice or receipt (mandatory)

Direct summary: as this is an impact sport, there is no warranty for heavy impact, dents, creases or signs of use.

6. Shipping damage (mandatory deadline)

The customer must check the product upon receipt.

Any damage must be reported:

  • At the time of delivery or
  • Within 48 hours of receipt, with photos/videos

After this period, it is understood that the product was delivered in perfect condition.

Subsequent claims may be refused, especially in cases with evidence of use.

7. Warranty procedure

To request an analysis, send the following to customer service:

  • Clear photos and videos of the issue
  • Original invoice/receipt (mandatory)
  • Description of what happened
  • Date of purchase

Orbit Brands may request that the product be sent in for physical inspection.

The total timeframe for analysis and resolution is up to 30 calendar days after receipt.

8. Resolution of approved cases

If a manufacturing defect is confirmed, Orbit Brands may:

  • Repair the product
  • Replace the product
  • Grant credit or a refund

9. Cases rejected under warranty

When no manufacturing defect is found:

  • The warranty claim will be denied
  • The customer may opt for a paid repair (when possible)
  • Shipping costs may be the customer's responsibility

10. Shipping for analysis

  • Do not send the product without prior contact
  • The product must be clean and dry
  • We recommend reinforced packaging and insurance

Shipping costs and risks follow the guidelines provided by customer service.

11. Installations and modifications

12. Disclaimer of liability

All products are used at the user's own risk.

These are not life-saving devices and do not replace:

  • Swimming ability
  • Knowledge of the ocean
  • Safety practices

Orbit Brands, manufacturers and distributors are not responsible for:

  • Accidents
  • Injuries
  • Death
  • Material damage or any losses resulting from use

13. Safety warning

Surfing and bodyboarding are sports that involve risks.

Recommendations:

  • Use a leash and proper equipment
  • Practice within your skill level
  • Avoid dangerous locations without prior knowledge
  • Do not surf alone
  • Respect other surfers
  • Take lessons with professionals if you are a beginner
  • Know how to swim before participating

Responsible use significantly reduces risks.

14. Good faith and misuse

Orbit Brands operates based on technical criteria and good faith.

Requests showing signs of warranty misuse may be denied.

15. Acceptance

By purchasing a product on our website, the customer declares that they are aware of and agree to this policy.
